Terms of Use

These Membership Terms and Conditions stipulate the conditions for participation in Yashima Auction (hereinafter "Auction"), which is hosted and operated by Yashima Shokai Co., Ltd. (hereinafter "Organizer").
Those who register and participate in the Auction are deemed to have accepted these Membership Terms and Conditions.
Furthermore, the Organizer may change the contents of these Membership Terms and Conditions as necessary.

【Eligibility to participate in the auction】

  1. 1. Eligibility and Application
    1. Only members who have registered in advance can participate in the auction.
    2. Membership registration is limited to one account per company.
  2. 2. Membership Registration
    1. Those who wish to participate must apply for membership registration on the auction website.
    2. After registration, you will be able to participate in the auction using the member ID and password issued by the organizer.
    3. Members are solely responsible for managing their member IDs and passwords. Members are solely responsible for any damages incurred as a result of theft, loss or leakage of their passwords, so please take great care when managing your password.
    4. If there are any changes to their registration information, members must contact the organizer immediately.
  3. 3. Deposit
    1. Members who have no transaction history with the organizer will be required to provide a deposit when bidding.
    2. The deposit is 100,000 yen and should be transferred to the following account before the auction begins.

    3. Remittance fees will be borne by the member.
    4. The deposit will be offset against the price of any successful items.
    5. If no items are sold within three months, the deposit will be confiscated.
  4. 4. Member Rights and Responsibilities
    1. Members have the right to participate in the auction and bid on exhibited products.
    2. Members are obligated to comply with the regulations set out in these terms and conditions and to abide by all results from the auction system.
    3. If the organizer suffers damages, losses, and expenses as a result of a member's violation of his or her obligations under these terms and conditions, the member shall compensate or indemnify the organizer for such damages, etc.
  5. 5. Prohibitions and Termination of Membership

    If any of the following reasons are deemed to apply to a member, the organizers may cancel the membership, withdraw from the membership, or suspend the membership without notice. The member may not object to any damages incurred as a result of the withdrawal, and the organizers shall not be held liable in any way.

    1. When there is a false statement in the membership registration application
    2. When the membership terms and conditions are violated
    3. When payment for the auction is not made
    4. When there is an act of disruption to the auction or of damaging the social credibility of the auction and the organizer
    5. When it is determined that the person belongs to or has a relationship with anti-social forces
    6. When there is a violation of relevant laws and regulations
    7. When the organizer otherwise determines that the person is ineligible to participate
  6. 6. Governing Law

    Use of our website and the interpretation and application of these terms and conditions shall be governed by the laws of Japan.

【Bidding and winning bids】

    1. The auction is only open to members via the Internet. Bids by telephone, fax or email are not accepted.
    2. All prices are in Japanese yen. Prices do not include consumption tax. For transactions within Japan, consumption tax (10%) will be added to the successful bidder.
      For overseas transactions, the displayed price is the FOB price.
    3. For items exhibited in the auction to be exported overseas, the price is the price at the organizer's designated port in Japan for delivery by the broker.
      For domestic transactions, the price is the price at delivery by our company.
    4. All items exhibited are second-hand and will be sold as is.
    5. After the auction for each exhibited item is over and the bids are tallied, a confirmation email will be sent to the successful bidder.
    6. After a successful bid, the organizer will issue a successful bid notice and invoice.
    7. No matter what the reason, a bid price cannot be changed, retracted, or canceled after the deadline.
    8. Costs for car washes, radiation testing, and other testing by public institutions are not included in the product price.

【Costs and delivery terms】

For overseas transactions, the winning bid price is the price assuming delivery to the organizer's designated port and designated broker displayed on this auction site.
For domestic transactions, the price is the price assuming delivery to our company.

【payment】

    1. Payment currency is Japanese yen only. Payment method is cash payment before delivery only. Bills, letters of credit, etc. are not accepted.
    2. Payment of the winning bid price must be completed within 10 days from the date of receiving the successful bid notice.

    3. If the winning bid price is not paid within one month of the successful bid notice, the organizer may cancel the sales contract.

【Delivery of goods】

    1. Once the organizer has confirmed the payment of the winning bid amount, the item can be delivered.
    2. As a general rule, the item is stored at the organizer's yard and, after confirmation of payment from the winning bidder, will be shipped in container units in the case of overseas transactions.
    3. If the winning bidder wishes to collect the won item from our yard, they must contact the organizer at least two business days prior to collection to confirm the date, time and transportation arrangements. If there is no prior contact, collection may not be possible.
    4. The collection period for won items in domestic transactions is within two weeks after the end of the auction. Please collect the item within this period. If the above collection period has passed, it will be considered a breach of the sales contract, and the buyer must pay the organizer the penalty described in [Payment] section ⑥.
    5. The winning bidder will be responsible for any accidents or problems that occur during collection or removal.

【Warranty and Indemnity】

    1. All items exhibited at auction will be traded on an as-is basis.
    2. The organizers make no guarantees about the exhibited items. Therefore, no complaints will be accepted regarding the quality or performance of exhibited or sold items.
    3. The organizers take no responsibility for the accuracy of the information about items exhibited at auction.
    4. The appraisal sheets for items published at auction are merely a guide for judging items based on the organizers' standards, and do not guarantee the quality of the items.
    5. If the organizers deem it necessary to change the item information and appraisal sheets after publication, they may change the content at any time.
    6. The organizers are not liable for damages caused by malfunctions in the operation of the auction due to failures in the auction's computer system or network, etc.
    7. The successful bidder shall handle any matters related to various domestic and international regulations and laws.

【Important Notes】

  1. 1. Export Control
    1. When using or exporting the successful bidder overseas, the successful bidder shall be responsible for complying with the export control laws and regulations of Japan and the destination country, trade-related instructions from the Japanese government, and rules in the international community, and taking the necessary measures.
    2. If it is determined that the export may be inappropriate in terms of security trade control, the organizer may cancel or terminate the successful bid or the sales contract.
    3. If concerns related to ① and ② above arise, and the exhibitor conducts review, examination, or investigation, the delivery date set out in these Membership Terms and Conditions may be delayed.
  2. 2. Changes to the Terms

    The Organizer reserves the right to modify these Terms and Conditions as necessary.

  3. 3. If any matter not stipulated in these terms and conditions arise or if there is any doubt regarding its interpretation, the organizer and the member shall consult with each other and seek to reach an amicable resolution in good faith.

【Exclusion of antisocial forces】

  1. 1. Those who currently or in the future fall under any of the following categories are ineligible to become Members:
    1. Organized crime groups, members of organized crime groups, associate members of organized crime groups, companies related to organized crime groups
    2. Corporate racketeers, political activists, social activists, or special intelligence violent groups (bank transfer fraud, etc.)
    3. Others who fall under any of the above categories.
  2. 2. Members are prohibited from engaging in any of the following acts, either by themselves or through a third party:
    1. Violent demands
    2. Unreasonable demands
    3. Threatening behavior or violence in relation to transactions
    4. Using fraudulent means or force to undermine the Company's credibility or interfere with the Company's business
    5. Other persons equivalent to the above

【Governing Law and Dispute Resolution】

This participation agreement is subject to the laws and regulations of Japan.
